Why should a document be notarized?
The notary verifies the identity of those who sign the document and certifies that those who sign it do so willingly and with an understanding of what they are signing. A notary deters fraud and identity theft.
What documents need to be notarized?
Many documents, such as deeds, powers of attorney and some affidavits, may not be considered legally binding without the notary’s stamp. Some documents may not be required by law to carry the notarial seal – however, having a notary attest to the document’s authenticity is an added assurance against fraud.
Does the notary public offer legal advice?
A notary public, other than a lawyer whom you have retained for legal advice, does not offer opinions on legal questions pertaining to your documents.
Can the notary public prepare legal documents?
Again, unless the notary public is your lawyer, whom you have retained for legal services, the notary public is not permitted to prepare legal documents.
